This website is operated by Zilion(a Hi5 Services NZ Limited Entity) . Throughout the site, the terms ”zilion.co.nz”, “zilion, “”zilion beauty”, “we”, “us” and “our” refer to Zilion . Zilion offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your region of residence.

1.2. You must not transmit any worms or viruses or any code of a destructive nature.

SECTION 2 - GENERAL CONDITIONS

2.1. We reserve the right to refuse service to anyone for any reason at any time.
2.2. You understand that your content (not including credit card information), may be transferred unencrypted. Credit card information is always encrypted during transfer over networks.
2.3. You agree not to reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission by us.

 

SECTION 3 - NEW ZEALAND CONSUMER LAW COMPLIANCE

As a New Zealand-based retailer, Zilion operates strictly under the following legislation:

3.1. Consumer Guarantees Act 1993 (CGA):
Nothing in these Terms is intended to exclude or limit your rights under the CGA. If you are purchasing products for personal, domestic, or household use, our products come with guarantees that cannot be excluded. This includes that goods must be of acceptable quality, fit for purpose, and match their description.

3.2. Fair Trading Act 1986 (FTA):
We are committed to the FTA, which prohibits misleading and deceptive conduct, unsubstantiated representations, and unfair trade practices. We ensure that all hair, beauty, and skincare claims are accurate and pricing is transparent.

3.3. Business Use:
If you are acquiring goods for the purposes of a business (e.g., a professional salon purchasing for resale or professional use), you agree that the provisions of the Consumer Guarantees Act 1993 do not apply as per Section 43(2) of the Act.

 

SECTION 4 - PRODUCT ACCURACY & ADVICE

4.1. Visuals: We make every effort to display the colors and images of our products (hair dyes, cosmetics, etc.) as accurately as possible. However, we cannot guarantee that your monitor's display of any color will be 100% accurate.
4.2. Skincare & Allergy Disclaimer: Zilion provides ingredient lists as supplied by manufacturers. It is your responsibility to check for allergens. We recommend a patch test for all new hair and skincare products.
4.3. Professional Products: Certain "Professional Use Only" hair products require technical expertise. Zilion is not liable for results occurring from the use of professional products by untrained individuals.

 

SECTION 5 - MODIFICATIONS TO SERVICE AND PRICING

5.1. GST: All prices are in New Zealand Dollars (NZD) and are inclusive of GST (Goods and Services Tax) unless stated otherwise.
5.2. Price Changes: Prices for our products are subject to change without notice.
5.3. Errors: In the event that a product is listed at an incorrect price due to a typographical error, we reserve the right to cancel orders placed at the incorrect price, even if the order has been confirmed and your credit card charged. If your card has been charged, we will issue a full refund immediately.

 

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

6.1. We reserve the right to refuse any order you place. We may, in our sole discretion, limit or cancel quantities purchased per person or per order.
6.2. You agree to provide current, complete, and accurate purchase and account information. You agree to promptly update your account and other information, including email address and credit card numbers, so that we can complete your transactions.

 

SECTION 7 - SHIPPING AND DELIVERY

7.1. Local Delivery: As your local shop, we aim for the fastest possible dispatch. Delivery timeframes provided are estimates only.
7.2. Risk and Title: Risk in the products passes to you upon delivery to the address provided. Ownership of the products passes to you only upon receipt of full payment.
7.3. Incorrect Address: Zilion is not responsible for orders delivered to an incorrect address provided by the customer.

 

SECTION 8 - RETURNS, REFUNDS AND CANCELATIONS

Our policy is governed by the Consumer Guarantees Act 1993.
8.1. Faulty Goods: If a product is faulty, unfit for purpose, or does not match the description, you are entitled to a repair, replacement, or refund.
8.2. Change of Mind: Under NZ Law, retailers are not required to provide a refund for a "change of mind." Please choose carefully. Returns for change of mind may be accepted at our sole discretion and may incur a restocking fee.
8.3. Hygiene Standards: Due to health and safety regulations, we cannot accept returns on opened skincare, makeup, or hair brushes or any other product unless the product is faulty.

 

SECTION 9 - THIRD-PARTY LINKS AND TOOLS

We may provide you with access to third-party tools (like payment gateways: Afterpay, Zip, etc.). We have no liability whatsoever arising from or relating to your use of optional third-party tools. Use them at your own risk and review their terms.

 

SECTION 10 - INTELLECTUAL PROPERTY

The content on this site, including logos, text, graphics, and images, is the property of Zilion or our content suppliers and is protected by New Zealand and international copyright laws.

13.1. We do not guarantee that your use of our service will be uninterrupted or error-free.
13.2. To the maximum extent permitted by New Zealand law, Zilion shall not be liable for any injury, loss, claim, or any direct/indirect damages arising from your use of any of the products procured using the service.

 

SECTION 14 - INDEMNIFICATION

You agree to indemnify and hold Zilion and our affiliates, partners, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to your breach of these Terms.

 

SECTION 15 - SEVERABILITY

In the event that any provision of these Terms is determined to be unlawful or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms.

 

SECTION 16 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New Zealand. You and Zilion Beauty agree to submit to the non-exclusive jurisdiction of the New Zealand Courts.

 

SECTION 17 - CHANGES TO TERMS OF SERVICE

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates to our website. It is your responsibility to check our website periodically for changes.
